A PEC determina que qualquer abertura de ação penal contra parlamentar depende de autorização prévia, em votação secreta, da maioria absoluta do Senado ou da Câmara
A Proposta de Emenda à Constituição (PEC) que dificulta o andamento de processos criminais contra deputados e senadores, incluindo até mesmo a execução de mandados de prisão, foi aprovada na noite de terça-feira, dia 16, pelo plenário da Câmara dos Deputados, em Brasília, em dois turnos de votação.
O texto-base, que dependia de 308 votos para avançar, entre 513 deputados, foi aprovado por 353 parlamentares, em votação de primeiro turno. Outros 134 deputados votaram contra o projeto, e houve uma abstenção.
No segundo turno, por volta das 23h30, cerca de duas horas depois da primeira votação, a PEC passou com o voto favorável de 344 deputados. Houve 133 votos contrários. Um requerimento para dispensar o intervalo de cinco sessões entre uma votação e outra foi aprovado por ampla margem para permitir o avanço da matéria.

Todos os destaques para mudar o texto, incluindo a exclusão do foro privilegiado para presidentes partidários, foram rejeitados em plenário. Após o fim da votação em segundo turno, deputados seguiram discutindo destaques para excluir pontos do texto.
A chamada de PEC da Blindagem (PEC 3 de 2021), ou PEC das Prerrogativas, foi articulada pela maioria dos líderes da Câmara com o apoio da oposição liderada pelo Partido Liberal (PL).
A bancada do Partido dos Trabalhadores (PT) orientou voto contrário, mas 12 deputados da legenda votaram a favor em primeiro turno. Também houve apoio à PEC entre deputados outros partidos da base, como PSB, PSD e PDT. Além disso, bancadas governistas, como lideranças de Governo e da Maioria, liberaram seus votos em plenário.
Tramitação difícil
Agora, a PEC será enviada ao Senado. Se avançar entre os senadores, processos judiciais, seja por desvio de emendas parlamentares ou outros crimes, só poderão ser julgados no STF com autorização dos parlamentares. Apesar disso, deve enfrentar resistência na Casa revisora. O presidente da Comissão de Constituição e Justiça (CCJ) do Senado, Otto Alencar (PSD-BA), demonstrou indignação com a iniciativa.
“A repulsa à PEC da Blindagem está estampada nos olhos surpresos do povo, mas a Câmara dos Deputados se esforça a não enxergar. Tenho posição contrária”, declarou em postagem nas redes sociais. Caberá à CCJ, presidida por Alencar, analisar tanto admissibilidade da PEC quanto seu mérito. Se for levado ao plenário, o texto precisará do voto de 49 entre 81 senadores.
O que foi aprovado
O texto aprovado na Câmara é um substitutivo relatado pelo deputado Claudio Cajado (PP-BA), que deu parecer favorável ao projeto.
A proposta permite que deputados e senadores barrem a prisão de colegas, em votação secreta. Defensores da medida dizem que a proposta é uma reação ao que chamam de abuso de poder do Supremo Tribunal Federal (STF) e que as medidas restabelecem prerrogativas originais previstas na Constituição de 1988, mas que foram mudadas posteriormente.
Em conversa com jornalistas, o deputado Cajado justificou que o texto não é uma autorização para “maus feitos”, mas apenas uma “proteção” para os deputados exercerem sua função sem medo de “perseguição política”.
“Isso aqui não é uma licença para abusos do exercício do mandato, é um escudo protetivo da defesa do parlamentar, da soberania do voto e, acima de tudo, do respeito à Câmara dos Deputados e ao Senado Federal”, disse.
O texto apresentado pelo relator afirma que: “Desde a expedição do diploma, os membros do Congresso Nacional não poderão ser presos, salvo em flagrante de crime inafiançável, nem processados criminalmente, sem prévia licença de sua Casa”.
Em outro dispositivo, a PEC define que a decisão deve ser decidida “por votação secreta da maioria absoluta de seus membros, em até noventa dias a contar do recebimento da ordem emanada pelo STF”. Maioria absoluta significa a metade dos parlamentares da respectiva Casa Legislativa mais um.
No caso de prisão por crime inafiançável, é necessário manifestação, em 24 horas, da Câmara ou do Senado, por votação secreta. A Casa poderá suspender a prisão com maioria simples que, diferentemente da maioria absoluta, requer a maioria dos parlamentares presentes na sessão e não do total.
Sobre o voto secreto, o relator Claudio Cajado sustentou que a modalidade “nunca deu problema”.
“Qual o problema do voto secreto? [É] para que todos tenham a sua consciência voltada para o pleno exercício da atividade parlamentar”, afirmou.
O relator justificou ainda a inclusão dos presidentes de partidos entre aqueles com direito ao foro por prerrogativa de função, só podendo ser processado pelo STF.
“Eles são ativistas na política. Eles complementam a atividade política. Então, qualquer processo sobre eles não tem que ter autorização, para ficar claro. Mas o foro fica sendo também igual aos dos deputados”, disse Cajado.
Já contrários à proposta alegam que a medida blindará deputados da possibilidade de serem processados e investigados por crimes de qualquer natureza, incluindo delitos comuns, como corrupção e atos de violência, por exemplo.
“Isso aqui é uma desmoralização do Parlamento brasileiro. Está voltando o voto secreto e a forma como vamos dar ao Poder Legislativo de anular o Judiciário, chantagear o Executivo e torná-lo o Poder, por excelência, no semipresidencialismo. Essa é a resposta à condenação ao golpe de Estado no país”, criticou o deputado Ivan Valente (PSOL-SP).
